1. Eligibility and Account Responsibilities

To use BizWaz, you must be a registered commercial entity, authorized representative, or an individual of at least 18 years of age. You agree to provide accurate, current, and complete registration information and to maintain the security of your account credentials. You are solely responsible for all messaging, automated workflows, and billing activities that occur under your workspace account.

2. Acceptable Use Policy & Anti-Spam Standards

BizWaz is engineered exclusively for legitimate business communications, customer relationship management, and opt-in transactional messaging. You agree NOT to:

• Send unsolicited spam, purchased contact lists, cold promotional blasts, or messages that violate WhatsApp Business Platform Policies or local telecom regulations.
• Distribute deceptive content, malicious software, unauthorized financial schemes, or defamatory material.
• Attempt to reverse-engineer, exploit rate limits, or disrupt the reliability of the BizWaz platform.

3. Official Meta WhatsApp Business API Compliance

BizWaz operates strictly via the official Meta WhatsApp Business Cloud API (WABA). You acknowledge that Meta enforces strict policies regarding pre-approved message templates, 24-hour service windows, customer opt-ins, and user block/report rates.

Customers are solely responsible for maintaining opt-in consent from their recipients. BizWaz provides quality monitoring and automated rate-limiting to protect your phone number quality rating, but is not liable for restrictions imposed directly by Meta due to policy violations by the customer.

4. AI Agent & Conversational Disclaimer

Our Agentic AI assistant and LLM Gateway generate responses based on advanced language models and your configured knowledge base. While engineered for high accuracy, AI responses are provided on an "as-is" assistive basis. The customer is responsible for reviewing AI prompt instructions, product catalogs, and monitoring human escalation rules.

5. Subscriptions, Fees & Indian GST

Subscription plans are billed in Indian Rupees (INR) or equivalent on a recurring monthly or annual basis. All listed prices are exclusive of applicable Indian Goods and Services Tax (18% GST). Subscriptions automatically renew unless cancelled prior to the end of the billing period.

6. 14-Day Free Trial Policy

BizWaz offers a 14-day full-featured free trial on all standard subscription plans. No credit card is required to begin. If you choose not to subscribe before the trial concludes, your account will simply pause with zero obligation.

7. Limitation of Liability

To the maximum extent permitted by applicable law, BizWaz, its directors, employees, and affiliates shall not be liable for any indirect, incidental, or consequential damages, including loss of business profits or third-party carrier delays. BizWaz's cumulative liability for any verified claim shall not exceed the subscription fees paid by you to BizWaz in the three (3) months preceding the event.

8. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in New Delhi, India.
